These Terms of Service (“Terms”) are a binding agreement between you and The Daybreak Digest (“we,” “us,” the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
1. The Service
The Daybreak Digest is a personalized morning briefing delivered by email, with an optional web dashboard, audio version, and podcast feed. We aggregate publicly available information and use AI to summarize it. We may add, change, or remove features at any time.
2. Eligibility & accounts
- You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.
- You’re responsible for your account, for keeping your password secure, and for activity under your account.
- Provide accurate information and keep it current.
3. Acceptable use
You agree not to:
- Break the law or infringe others’ rights using the Service.
- Attempt to disrupt, overload, reverse-engineer, scrape, or gain unauthorized access to the Service or its infrastructure.
- Resell, redistribute, or republish digest content or audio commercially without permission.
- Use the Service to send spam or to abuse the underlying AI or data providers.
4. Subscriptions, billing & payments
The Service may offer free and paid plans. Paid plans are billed through our payment processor, Stripe. By purchasing a paid plan you agree to the following:
- Authorization: you authorize us (via Stripe) to charge your selected payment method the applicable fees, plus any taxes.
- Auto-renewal: subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price until you cancel.
- Cancellation: you may cancel any time from your account; cancellation takes effect at the end of the current billing period, and you keep access until then.
- Refunds: except where required by law, payments are non-refundable and there are no refunds or credits for partial periods. We may, at our discretion, offer a refund in individual cases.
- Price changes: we may change prices; we’ll give notice before a change affects your next renewal, and continued use after the change means you accept the new price.
- Failed payments: if a charge fails, we may retry, downgrade, or suspend paid features until payment succeeds.
- Free trials/tiers: if offered, we may modify or end them at any time.
We don’t store your full card details; Stripe processes and secures your payment information under its own terms and privacy policy.
5. Not financial, investment, or professional advice
The Service includes market data, prices, and news for informational purposes only. It is not financial, investment, legal, tax, medical, or other professional advice, and nothing in it is a recommendation to buy or sell any security or asset. Market data may be delayed, incomplete, or inaccurate. Always do your own research and consult a qualified professional before making decisions. You are solely responsible for any actions you take.
6. Third-party content & accuracy
Digest content is generated by AI from third-party sources and may contain errors, omissions, or outdated information. We don’t guarantee accuracy, completeness, or timeliness, and we’re not responsible for third-party websites we link to. Headlines and data belong to their respective owners.
7. Intellectual property
The Service’s software, design, branding, and original compilation are owned by us. We grant you a personal, non-exclusive, non-transferable license to use the Service and read your own digests for personal use. You retain ownership of the preferences and content you provide.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don’t warrant the Service will be uninterrupted, error-free, secure, or that delivery will always be timely.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.
10. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service or violation of these Terms.
11. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (e.g., payment obligations, disclaimers, limitation of liability) will survive.
12. Governing law & disputes
These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law rules. You agree that disputes will be resolved in the state or federal courts located in Maryland, and you consent to their jurisdiction — except where applicable law gives you the right to bring claims elsewhere. To the extent permitted by law, claims must be brought individually and not as part of a class action.
13. Changes to these Terms
We may update these Terms; we’ll revise the date above and, for material changes, notify you. Continued use after changes means you accept them.
